Gerard Cervi (36), from East Wall in North Dublin pleaded not guilty to murdering Robert ‘Bobby’ Messett and the attempted murders of boxing coach Pete Taylor and a man named Ian Britton
Fingerprints belonging to a man accused of murder at Bray Boxing Club were found on bottles in a van alleged to have been used in the crime, the State alleges.The court heard how Mr Messett was shot in the head and died instantly during an incident in which a gunman came up the stairs, stood in the doorway during an exercise class led by Pete Taylor - and fired a total of nine shots.
Mr Murray told how a silver or grey Volkswagen Caddy van discovered on Pigeon House Road in North Dublin is alleged to be the same one used by the gunman who left Bray Boxing Club that morning. Mr Murray said that on top of that DNA analysis was carried out on a part of fabric on the left passenger seat of the van and swabs were also taken from the handbrake. He said the court will hear evidence from an expert in relation to a connection made between DNA found on the safety fabric and swabs made and Mr Cervi.
Mr Murray said that Mr Messett was “shot in the head and died quickly at the scene.” Further into the room there were other participants including Ian Britton - who the court heard was shot but survived. He told the jurors that they will see CCTV during the course of the trial showing the journey that the prosecution say is of that vehicle traveling from Bray Boxing Club to Pigeon House Road in Dublin. There will also be a “considerable” amount of other CCTV footage shown to the jury as well, the court heard.
The court was shown a CCTV still of the man the prosecution alleges is Mr Cervi inside the McDonalds wearing checkered shorts - and the woman alleged to be his partner wearing a “distinctive white and black blouse.” The prosecution will also lead evidence that on the day before the shooting the same Volkswagen Polo - which is registered in the name of Mr Cervi’s mother, and in which is driving licence was later found, made two journeys from East Wall in the general direction out to Pigeon House Road.
In a still of footage shown to the court a man is seen wearing a white cap and a yellow high vis jacket and pullover trousers and the prosecution says this is the same person seen running back in the direction of the van.
